Bulgaria’s Commission for Protection of Competition (CPC) fined the Austrian hipermarket for furniture and accessories Mebeli Ludwig Bulgaria EOOD (COMO) for misleading advertising. 

The CPC initiated the proceedings upon a claim filed by another furniture retailor Enikom-M OOD for violations in conjunction with Art. 29 and Art. 32 in connection with Art. 33 of the Law on Protection of Competition (LPC).

The Bulgarian Supreme Administrative Court (SAC) dismissed the appeal of VOLVO Trademark Holding AB (hereinafter – Volvo) against the decision of the Sofia Administrative Court which confirmed the opposition decision of the Bulgarian PTO which found no likelihood of confusion between the earlier trade mark VOLVO and the trade mark application for the combination trade mark VALVO.

The CPC initiated a claim for misleading advertising on the grounds of the advertisement of the 7 days “Pizzeti” snacks. It was argued that the below described advertisement may lead to a false perception among consumers with regard to the origin and the product’s recipe as the video creates the understanding that the product is Italian and is similar to the famous Italian “Pizza”.
